2. Collection and storage of personal data, and the nature and purpose of its use

 

a) When visiting the website

When you visit our website www.fta.info using the browser on your device, information is automatically sent to our website’s server. This information is temporarily stored in a log file. The following information is collected automatically and stored until it is automatically deleted:

  • IP address of the requesting computer,
  • date and time of access,
  • name and URL of the file accessed,
  • website from which the access originated (referrer URL),
  • browser type and version, as well as other information transmitted by the browser (such as your computer’s operating system, the name of your internet service provider, geographical location, language settings, etc.).

We process the data mentioned above for the following purposes:

to enable the use of the website (establishing a connection)

to ensure the long-term security and stability of the system

to enable the technical administration of the network infrastructure

to enable the optimisation of the website

  • for internal statistical purposes.

The legal basis for data processing is Article 6(1)(f) of the GDPR. Our legitimate interest arises from the purposes of data collection listed above. Under no circumstances do we use the data collected for the purpose of identifying you personally.

In addition, we use cookies and analytics services when you visit our website. Further details on this can be found in sections 4 and 5 of this privacy policy.

 

b) When placing an order in the online shop

Orders are generally placed as a guest. If you wish to set up a password-protected user account with us, you can do so voluntarily during the ordering process or on the homepage under ‘Login’ or ‘Register’. See also section 2c

If you wish to order products via our website, we collect the following information:

Title, first name, surname,

a valid email address,

postal address,

telephone number (optional, facilitates communication in case of any queries)

  • payment details, depending on the payment method you have selected (for example, payment on account or credit card details).

This data is collected

to enable us to identify you as our contractual partner;

to check the validity of the data you have entered;

to process payment for your order; and

  • to handle any warranty claims that may arise, as well as to enforce any claims against you.

 

Data processing is carried out at your request and is necessary, in accordance with Article 6(1)(b) of the GDPR, for the purposes stated, namely the performance of the contract and pre-contractual measures.

The personal data collected by us in connection with the order will be stored until the expiry of the statutory warranty period and will then be automatically deleted, unless we are obliged to store it for a longer period pursuant to Article 6(1)(c) of the GDPR due to retention and documentation obligations under tax and commercial law (under the German Commercial Code (HGB), the German Criminal Code (StGB) or the German Fiscal Code (AO)), or you have consented to further storage in accordance with Article 6(1)(a) of the GDPR.

c) When setting up a user accountSie haben die Möglichkeit, to set up a password-protected user account with us, in which we will store your personal data. This is to ensure that you enjoy the greatest possible convenience when processing your orders, through a simpler, faster and more personalised checkout process.

If you wish to set up a password-protected user account with us, we require the following information from you:

telephone number (optional, facilitates communication in case of any queries)

  • payment details, depending on your chosen payment method (for example, payment on account or credit card details).

In addition, to set up a user account, you must provide a password of your choice and a username. These details allow you to access your user account. You can view and amend the data stored about you in your user account at any time.

We will only store your personal data in a user account if you have voluntarily given us your consent to do so in accordance with Article 6(1)(a) of the GDPR.

Creating a user account is not required to use our website or to place orders with us. We also offer you the option of placing your order as a guest

d) When signing up for our newsletter

Provided you have given your explicit consent in accordance with Article 6(1)(a) of the GDPR, we will use your email address to send you our newsletter on a regular basis. To receive the newsletter, you simply need to provide your first name, surname and an email address. You can unsubscribe at any time, e.g. via a link at the end of each newsletter. Alternatively, you are welcome to send your request to unsubscribe by email to datenschutz@fta.info at any time.

e) When using our contact form

If you have any questions, we offer you the option of contacting us via a form provided on the website. You must provide a valid email address so that we know who has sent the enquiry and can reply to it. Further details may be provided on a voluntary basis. Data processing for the purpose of contacting us is carried out in accordance with Article 6(1)(a) of the GDPR on the basis of your voluntary consent. The personal data we collect when you use the contact form will be automatically deleted once your enquiry has been dealt with.

3. Disclosure of data to third parties

Your personal data will not be disclosed to third parties for any purposes other than those listed below.

 

a) Forwarded to FTA Fahrzeugtechnik AG

Your personal data will also be passed on to FTA Fahrzugtechnik AG, Suhrenmattstrasse 18, 5035 Unterentfelden, Switzerland.

The data is shared for the purposes of marketing and our business analyses.

The sharing of data is based on Article 6(1)(f) of the GDPR, whereby the aforementioned purposes are to be regarded as legitimate interests within the meaning of this provision.

b)Contract processing

Where permitted by law and where necessary for the performance of contractual relationships with you in accordance with Article 6(1)(b) of the GDPR, your personal data will be disclosed to third parties. This includes, in particular, the transfer of data to delivery companies for the purpose of delivering the goods you have ordered and the transfer of payment data to payment service providers or credit institutions in order to process a payment transaction. The data transferred may only be used by the third party for the purposes stated.

c) Regarding identity verification and credit checks

In the event that we make an advance payment for a purchase you have made, for example when purchasing on account, we may, in accordance with Article 6(1)(a) and (b) of the GDPR, obtain a credit reference based on mathematical and statistical methods, provided we have your explicit consent and where this is necessary for the conclusion or performance of the contract.

We pass on your bank details to an external service provider for this purpose. We work with Creditreform e.V. and CRIF AG as part of our identity and credit checks.

The service provider we have engaged provides us with information, based on your personal data, regarding the statistical probability of a payment default. We use this information to make a considered decision regarding the establishment, performance or termination of the contractual relationship.

The credit report may contain probability values (score values) calculated using scientifically recognised mathematical and statistical methods, which incorporate address data, amongst other factors. Further information on this can be found in the privacy policies of Creditreform e.V. and CRIF AG.

 

d) For other purposes

Furthermore, we will only disclose your personal data to third parties if:

you have given your explicit consent in accordance with Article 6(1)(a) of the GDPR,

the disclosure is necessary in accordance with Article 6(1)(f) of the GDPR for the establishment, exercise or defence of legal claims and there is no reason to assume that you have an overriding legitimate interest in the non-disclosure of your data, and

  • in the event that there is a legal obligation to disclose the data in accordance with Article 6(1)(c) of the GDPR.

4. Cookies

Cookies are small text files that your web browser stores on your computer’s hard drive or in its memory when you visit our website. Cookies are assigned identification numbers that allow your browser to be identified and the information contained in the cookie to be read.

 

Among other things, cookies help to make your visit to our website easier, more enjoyable and more useful. We use cookies for various purposes that are necessary for the use of the website you have requested, i.e. they are ‘technically necessary’. For example, we use cookies to identify you as a registered user after you have logged in, so that you do not have to log in again each time you navigate to different subpages. The shopping basket and ordering functions also rely on the use of cookies. Furthermore, cookies perform other technical functions necessary for the operation of the website, such as load balancing – that is, distributing the site’s traffic load across different web servers to reduce the load on individual servers. Cookies are also used for security purposes, for example to prevent the unauthorised posting of content. Finally, we also use cookies as part of the design and programming of our website, for example to enable the uploading of scripts or code.

The data processed by cookies is necessary for the purposes stated in order to safeguard our legitimate interests and those of third parties in accordance with Article 6(1)(f) of the GDPR.

5. Analytical tools

The tracking and targeting measures listed below and used by us are carried out on the basis of Article 6(1)(f) of the GDPR.

We use these tracking measures to ensure that our website is designed to meet your needs and is continuously optimised. We also use these tracking measures to statistically record the use of our website and to evaluate this data for the purpose of optimising our offering for you.

Through the targeting measures used, we aim to ensure that only advertising tailored to your actual or presumed interests is displayed on your devices.

These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

The respective data processing purposes and data categories can be found in the relevant tracking and targeting tools.

6.Google Analytics

We use the web analytics service Google Analytics provided by Google Ireland Limited (Gordon House, Barrow St, Dublin 4, D04 E5W5, Ireland) or Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) (‘Google’). In doing so, the data described regarding the use of the website may be transferred to the servers of Google LLC in the EU and/or the USA for the processing purposes explained (see section 12.1).

The IP address may be truncated by activating IP anonymisation (“anonymizeIP”) on this website prior to transmission within the Member States of the European Union or in other signatory states to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and truncated there. Users can prevent the collection of data generated by the cookie and relating to the user’s use of the website (including the IP address) by Google, as well as the processing of this data by Google, by downloading and installing the browser plugin available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

When data is collected in Google Analytics 4, IP addresses are not logged or stored. In Analytics, all IP addresses collected from users in the EU are anonymised before being recorded via EU domains and servers. Analytics does not provide precise location data. Instead, the following metadata is derived from IP addresses: ‘City’ (and the derived latitude and longitude of the city), ‘Continent’, ‘Country’, ‘Region’, ‘Subcontinent’ (and the ID-based equivalents).

For access originating from the EU, IP address data is used solely to derive location data and is deleted immediately afterwards. It is not logged, is not accessible and is not used for any other purposes. When collecting measurement data in Analytics, all IP lookups take place on EU-based servers before the traffic is forwarded to Analytics servers for processing.

You can prevent the installation of cookies by adjusting your browser settings accordingly; however, we would like to point out that in this case, you may not be able to use all the functions of this website to their full extent.

In addition, you can prevent the collection of data generated by the cookie and relating to your use of the website (including your IP address), as well as the processing of this data by Google, by downloading and installing a browser add-on.

a) Google AdWords Conversion

We also use Google Conversion Tracking to collect statistical data on the use of our website and to analyse this data with a view to optimising our service for you. In this process, Google AdWords places a cookie (see section 4) on your computer if you have arrived at our website via a Google advert.

These cookies expire after 30 days and are not used for personal identification. If the user visits certain pages on the AdWords customer’s website and the cookie has not yet expired, Google and the customer can recognise that the user clicked on the advert and was redirected to that page.

Each AdWords customer is assigned a unique cookie. This means that cookies cannot be tracked across the websites of AdWords customers. The information collected via the conversion cookie is used to generate conversion statistics for AdWords customers who have opted in to conversion tracking. AdWords customers are informed of the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

If you do not wish to participate in the tracking process, you can also refuse the setting of the cookie required for this purpose – for example, by adjusting your browser settings to disable the automatic setting of cookies in general. You can also disable cookies for conversion tracking by configuring your browser to block cookies from the domain “www.googleadservices.com”. b) Crazy Egg

We also use the analytics service provided by Crazy Egg Inc. (16220 E. Ridgeview Lane, La Mirada, CA 9063, USA) on our website. Crazy Egg is a tool for analysing user behaviour. Crazy Egg enables us to measure and evaluate the behaviour of visitors to our website (e.g. mouse movements in the form of ‘heatmaps’, clicks, scroll depth, etc.). To this end, Crazy Egg places cookies (see section 4) on visitors’ devices and may store data from visitors such as browser information, operating system, time spent on the site and IP address, etc. You can prevent this data processing by Crazy Egg by disabling the use of cookies in your web browser settings and deleting any cookies that are already active. Another way to prevent data processing by Crazy Egg is to enable the “Do Not Track” function in your browser. You can find out how to set this up here.

c) Google AdWords Remarketing

We use Google Remarketing Tags. These are services provided by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; hereinafter “Google”). Google uses cookies (see section 4) which are stored on your computer and enable an analysis of your use of the website. The information generated by the cookie regarding your use of this website (including your IP address) is transmitted to a Google server in the USA and stored there. Google then truncates the IP address by the last three digits, meaning that a unique identification of the IP address is no longer possible. Google complies with the data protection provisions of the “US Safe Harbour” Agreement and is registered with the US Department of Commerce’s “Safe Harbour” programme. Google will use this information to evaluate your use of the website, to compile reports on website activity for the website operators and to provide other services relating to website and internet usage.

 

Google may also transfer this information to third parties where required to do so by law, or where such third parties process the data on Google’s behalf. Third-party advertisers, including Google, display adverts on websites across the internet. Third-party advertisers, including Google, use stored cookies to display adverts based on a user’s previous visits to this

website. Google will not associate your IP address with any other data held by Google. You may object to the collection and storage of data at any time with future effect.

 

You can disable the use of cookies by Google by visiting the page for disabling Google advertising. Please note, however, that in this case you may not be able to make full use of all the features of this website. By using this website, you consent to the processing of data collected about you by Google in the manner described above and for the purpose stated above.

7. Rights of data subjects

You have the right:

  • pursuant to Article 7(3) of the GDPR, to withdraw your consent at any time. As a result, we will no longer be permitted to process your data on the basis of that consent;

 

  • in accordance with Article 15 of the GDPR, to request information about your personal data processed by us. In particular, you may request information regarding the purposes of processing, the categories of personal data, the categories of recipients to whom your data has been or will be disclosed, the intended storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data, provided that it was not collected by us, as well as information on the existence of automated decision-making, including profiling, and, where applicable, meaningful information regarding its details;

 

  • in accordance with Article 16 of the GDPR, to request the rectification of inaccurate personal data or the completion of your personal data stored by us without undue delay;

 

  • to request the erasure of your personal data stored by us in accordance with Article 17 of the GDPR, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise or defence of legal claims;

 

  • to request the restriction of the processing of your personal data in accordance with Article 18 of the GDPR, where you contest the accuracy of the data, the processing is unlawful but you oppose its erasure and we no longer require the data, but you require it for the establishment, exercise or defence of legal claims, or you have objected to the processing in accordance with Article 21 of the GDPR;

 

  • in accordance with Article 20 of the GDPR, to receive the personal data you have provided to us in a structured, commonly used and machine-readable format, or to request that it be transferred to another controller, and
  • in accordance with Article 77 of the GDPR, to lodge a complaint with a supervisory authority. As a rule, you may contact the supervisory authority for your usual place of residence or workplace, or for our company’s registered office.

8. Right to object

Where your personal data is processed on the basis of legitimate interests pursuant to Article 6(1)(f) of the GDPR, you have the right, under Article 21 of the GDPR, to object to the processing of your personal data, provided there are grounds relating to your particular situation or the objection relates to direct marketing. In the latter case, you have a general right to object, which we will honour without you needing to specify a particular situation.

9. Data security

During the ordering process, we use the widely adopted SSL (Secure Sockets Layer) protocol in conjunction with the highest level of encryption supported by your browser. This is usually 256-bit encryption. If your browser does not support 256-bit encryption, we will use 128-bit v3 technology instead. You can tell whether a particular page on our website is being transmitted securely by the closed key or padlock symbol in the status bar at the bottom of your browser.

We also employ appropriate technical and organisational security measures to protect your data against accidental or deliberate manipulation, partial or complete loss, destruction or unauthorised access by third parties. Our

security measures are continuously improved in line with technological developments.
